Algunas versiones del realismo jurídico pretenden compatibilizar la pretensión de que el derecho es un conjunto de normas con un fuerte compromiso con el empirismo. De conformidad con este último, el derecho no está constituido por entidades abstractas de ningún tipo sino por hechos empíricamente constatables. En vistas a llevar a cabo esta compatibilización, en varios trabajos Riccardo Guastini ha defendido una concepción de las proposiciones normativas, i.e. aserciones existenciales sobre normas jurídicas, como enunciados teóricos acerca del derecho vigente, necesariamente (...) referentes a ciertos hechos. Se concibe así al derecho vigente como el conjunto de textos que son resultado de interpretaciones estables, consolidadas y dominantes que los jueces han llevado a cabo en sus decisiones en el ordenamiento de que se trate. Partiendo de esta versión del realismo jurídico, este trabajo procura sembrar algunas dudas. Primero, sobre este modo de concebir a las proposiciones normativas. Segundo, sobre el modo en que, en consecuencia, queda configurada la teoría del derecho. Tercero, y más en general, sobre la pretensión de compatibilizar la visión del derecho como conjunto de normas con la tesis empirista. (shrink)

El autor lleva a cabo una revisión de la obra The Many Faces of Normativity intentado resaltar algunos rasgos comunes que se van presentando a lo largo de los diversos textos que componen la obra revisada. Luego de abordar la visión de Robert Audi acerca de las tendencias hacia la naturalización de la normatividad así como el análisis que Jaap Hage efectúa de los conceptos normativos, se tratan dos ataques a la distinción ser-deber ser que defienden argumentos que, sobre la (...) base de esa distinción, han sido considerados falaces al menos desde David Hume. Posteriormente se tratan una serie de aportes con una tendencia común, y que a criterio del autor dan una especial identidad a la obra en su conjunto. Se trata de la tendencia, en buena medida reduccionista, que acopla la explicación de la normatividad a hipótesis provenientes del flamante campo de las neurociencias. (shrink)

Riletta dopo piů di centocinquant'anni dalla sua stesura, la Deutsche Ideologie puň risvegliarci dal "sonno dogmatico" ricordandoci che ogni dispositivo ideologico presenta per sua natura una strutturazione tale per cui l'ideologia si dispiega e si impone quanto piů si nega (...) e si fa impercettibile. Quanto piů l'epoca dice di essere non-ideologica, post-ideologica e anti-ideologica, tanto piů essa presenta un occulto ma, non per questo, meno intenso tasso ideologico: il movimento teorico con cui il nostro tempo nega l'ideologia č, esso stesso, una sotterranea articolazione ideologica, un ipertrofico lavoro carsico dell'ideologia. The paper focuses on the philosophical challenges of governance over trustless ledgers, namely Bitcoin Layer 2 solutions in El Salvador. Blockchain adoption in El Salvador is an example of policy based on a ‘frontier epistemology’ (Nickles 2009 ), creating a situation where “facts are uncertain, values are in dispute, stakes are high, and decisions are urgent” (Funtowicz and Ravetz 1993 ). Trustless ledgers play a role of such ‘frontiers’ of knowledge and governance that support a variety of technocratic, heuristic, and (...) experimental policy approaches. They challenge the traditional knowledge frameworks and governance processes responsible for attempts to embed (align) predetermined ideologies (values and stakes) into the technology over standards. Instead, as amalgams of social, political, legal, and economic interventions, ledgers function simultaneously as a contract, a monetary system, a political value commitment, and a governance structure. By integrating facts, values, and stakes into algorithms, they define the frontiers of epistemology and governance in two opposing ways. On the one hand, trustless ledgers embody Augustine’s Civitas Dei (the City of God) as a new design (novum consilium) that promises a future world (futurum saeculum) (Augustine 1968 ). With a promise of a system, where everyone is ‘free’ to not being able to ‘sin’ (non posse peccare - delet the res non peccare), social agency is reduced to a code of a trustless infrastructure. On the other hand, ledgers support experimental (Sabel and Zeitlin 2012 ) and heuristic policymaking (Nickles 2009 ) that saves social agency and cuts ‘through traditional discovery/justification and descriptive/ normative distinctions’ (Nickles 2009 ). The distributed ledgers as governance experiments then redefine Civitas Terrena’s governance as a challenge of ‘heuristic appraisal’ (Nickles 2009 ), ‘directly deliberative polyarchy’ (Cohen and Sabel 1997 ), and ‘experimentalist governance’ (Sabel and Zeitlin 2012 ). To elaborate on the blockchain governance experiments, we will use two Bitcoin initiatives in El Salvador (Bitcoin City and Bitcoin Beach) and discuss them in the context of a broader adoption of blockchain in South America. : Michael Gazzaniga, a prominent cognitive neuroscientist, has argued against reductionist accounts of cognition. Instead, Gazzaniga defends a form of non-reductive physicalism: epistemological neuro-cognitive non-reductionism and ontological monist physicalism. His position is motivated by the theses that: cognitive phenomena can be realized by multiple neural systems; many outcomes of these systems are unpredictable; and multi-level explanations are required. Epistemological neuro-cognitive non-reductionism is presented as the most appropriate stance to account for the way in which phenomena should be explained in cognitive (...) neuroscience. In this paper, I argue, however, that a recent form of neuro-cognitive reductionism, namely neo-mechanistic reductionism accounts for the arguments presented by Gazzaniga. Thus, the theory offers a more consistent and well-articulated view of the relationship between cognitive and neural phenomena that is specifically compatible with the explanatory strategies and aims of contemporary cognitive neuroscience. Al contrario Gazzaniga difende una forma di fisicalismo non-riduzionistico che risulta dalla combinazione, sul piano epistemologico, di un anti-riduzionismo cognitivo e, sul piano ontologico, di un monismo fisicalista. La sua posizione è motivata dalla tesi per cui i fenomeni cognitivi possono essere realizzati da molteplici sistemi neurali; molti esiti di tali sistemi non si possono prevedere; e sono pertanto necessarie spiegazioni a livelli plurimi. La concezione presentata come più adeguata per dare conto sul piano epistemologico di come i fenomeni dovrebbero essere spiegati all’interno delle neuroscienze cognitive è una forma di anti-riduzionismo neuro-cognitivo. In questo articolo si sostiene tuttavia che una recente forma di riduzionismo neuro-cognitivo può dare conto degli argomenti presentati da Gazzaniga. Si tratta di una teoria che offre una interpretazione maggiormente coerente ed articolata della relazione fra fenomeni cognitivi e neurali e che offre un modello di spiegazione compatibile con gli scopi esplicativi delle neuroscienze cognitive contemporanee. _Abstract_: We argue that theoretical debates in biology and cognitive science often are based around differences in the posited _locus of control _for biological and cognitive phenomena. Internalists about locus of control posit that specific causal control over the phenomenon is exerted by factors internal (to the relevant subsystem) of an organism. Externalists posit that causally specific influence is due to external factors. In theoretical biology, we suggest, a minimal agreement has developed that the locus of control for heritable variation (...) is _distributed _– that is, both internal and external factors exert specific, non-redundant causal influence on evolved traits. We suggest that debates in cognitive science, particularly surrounding “enactivism”, should also embrace a distributed locus of control. We show how both internal and external factors contribute non-redundantly to psychological capacities and behavior. Posizioni internaliste rispetto al _locus di controllo_ ritengono che il controllo causale specifico su un fenomeno biologico o cognitivo venga esercitato da fattori interni a (un sottosistema rilevante) di un organismo. Al contrario, posizioni esternaliste assumono che specifiche influenze causali siano dovute a fattori esterni. In questo articolo mostriamo che nell’ambito della biologia teorica si è giunti a un minimo accordo rispetto al fatto che il _locus di controllo_ per l’emergere di variazioni ereditarie è _distribuito _– ossia dovuto sia a fattori interni che esterni all’organismo che esercitano influenze specifiche e non-ridondanti sui tratti che si sono evoluti. Riteniamo che tale accordo debba essere raggiunto anche nell’ambito della scienza cognitiva, in particolare per quel che concerne l’_enattivismo_. In questo articolo mostriamo che sia i fattori interni che quelli esterni contribuiscono in maniera non-ridondante alle capacità psicologiche e al comportamento di un individuo. Recentemente, sulla rivista «Nature», i progressi empirici della teoria dell’evoluzione sono stati descritti nei termini di un confronto tra «riformisti», i quali auspicano una revisione dell’approccio neodarwiniano standard attraverso l’inclusione di fattori e processi fino ad ora trascurati, e «conservatori», secondo i quali l’attuale programma di ricerca evoluzionistico, basato sulla variazione genetica e sulla selezione naturale, «va bene così». Il dissidio, che concerne principalmente il problema del riduzionismo genetico, sembra non portare a nessun risultato. I riformisti mettono in luce dei (...) fattori molto importanti, ma paiono non portare ancora nessuna proposta coerente quanto alla struttura di questa versione estesa della teoria evoluzionistica a venire. I conservatori si mettono sulla difensiva, facendo affidamento soltanto su quelle aggiunte che non modificano il nucleo neodarwiniano quanto ai suoi tratti essenziali, mantenendolo ben saldo nei vecchi connotati. Analizziamo qui il suddetto dibattito, proponendone un’interpretazione. La biologia evoluzionistica è un campo di ricerche in rapida espansione. L’oggetto del contendere è la modalità di estendere e aggiornare il nucleo centrale dell’eredità darwiniana. La nostra ipotesi è che, nel campo della biologia evoluzionistica attuale, si stia producendo un avanzamento del programma di ricerca, la cui struttura è composta da una serie di pattern evolutivi integrabili e compatibili tra di loro. Nel corso della sua storia la biologia evoluzionistica si è infatti accresciuta tramite l’inclusione progressiva di modelli diversi, senza che questo significasse una revisione del nucleo della teoria. La «teoria gerarchica» di Niles Eldredge è un esempio di struttura globale che si propone come fine quello di incorporare e unificare i pattern evoluzionistici attualmente accettati. (shrink)

Da quando Spengler, nel secondo volume del Tramonto dell’Occidente (1922), ha preso a prestito dalla terminologia mineralogica la nozione di «pseudomorfosi» per applicarla alla morfologia delle culture e all’interpretazione dei rapporti fra differenti tradizioni culturali, questo concetto si è ampiamente diffuso nel vocabolario della filosofia e delle scienze umane. Il presente articolo si ripropone di ricostruire alcune tappe fondamentali della storia degli effetti di tale prestito, indagandone al contempo le oscillazioni dello spettro semantico e le implicazioni metodologiche ed epistemologiche. In (...) Spengler il concetto viene assunto in accezione fondamentalmente negativa, per descrivere un fenomeno di costrizione morfologica: una cultura nuova è costretta dalla forza d’inerzia di una cultura precedente ad assumere forme estranee per manifestare i propri contenuti. Diversi lettori del Tramonto mutuano tale termine adattandolo alle proprie ricerche: Jonas per esplorare la relazione fra la gnosi e le tradizioni greca, orientale e cristiana; Mumford per analizzare le connessioni fra i recenti progressi tecnologici e le vecchie forme del potere e dell’economia; Adorno per condannare perniciose mimesi (la filosofia che imita le scienze; l’arte che imita il linguaggio concettuale; la musica che imita la pittura). Tutti condividono l’idea che la pseudomorfosi consista in una falsa manifestazione formale, che finisce per mascherare l’espressione di un contenuto autentico e originario; inoltre, l’adozione di forme vecchie per comunicare contenuti nuovi favorisce analogie e somiglianze meramente superficiali e sostanzialmente infondate. Anche Panofsky accoglie la nozione nella sua iconologia, imprimendo tuttavia al concetto curvature differenti in diversi momenti della sua opera: in Studies of Iconology (1939) si riconosce alla pseudomorfosi una positiva valenza euristica, capace di portare ad espressione, nel Rinascimento, contenuti rimasti inespressi nell’antichità grazie alla sopravvivenza di elementi della mediazione medievale. Una complessa relazione a tre tempi, dunque, che mette in luce un poietico movimento retroattivo del presente sul passato remoto grazie alla metabolizzazione del presente prossimo: una significativa riqualificazione della funzione pseudomorfica (già adombrata dalle ricerche di Warburg sul Nachleben der Antike), che tuttavia si perde nella successiva riflessione panofskyana, dal momento che in Tomb Sculpture (1964) torna a riaffermarsi l’accezione negativa e semplificatoria di pseudomorfosi come apparente ma infondata analogia formale. Assunto in questo senso peggiorativo, il termine trapassa nella successiva storiografia artistica (ad esempio in Rosenblum e Bois). Ma l’affermarsi, in tempi recenti, di una rivalutazione dei fenomeni di anacronismo (Didi-Huberman, Nagel, Wood, Powell) sta comportando, in parallelo, una riqualificazione delle potenzialità euristiche della retroazione pseudomorfica. Per potersi realizzare compiutamente, tale riqualificazione deve accompagnarsi con una coerente teoria delle somiglianze. (shrink)

Come sappiamo, subito dopo la separazione da Freud Jung vive un periodo di «incertezza interiore, anzi di disorientamento». Ha abbandonato le teorie freudiane, ma non ne ha di proprie. Ha perso quello che lui stesso definisce «un punto d’appoggio». Si rivolge ai propri sogni, che sempre più spesso assumono la forma di incubi, e prende atto che non riesce a spiegarli utilizzando l’idea freudiana dell’inconscio come contenitore dei residui di vecchie esperienze pregresse. Essi gli appaiono come ricchi di forme che (...) non sono affatto morte, ma appartengono alla psiche vivente. Lo impressionano fortemente, senza però aiutarlo a risolvere il suo disorientamento. Non gli resta perciò altro da fare che «aspettare, continuare a vivere, e prestare attenzione alle fantasie». Ma ascoltiamo la vicenda così come è narrata dallo stesso Jung:. (shrink)

Il saggio si interroga sul rapporto tra immagine di libro e lettura, muovendo dalla constatazione che solo la trasformazione dei lettori in ambito umanistico (con il rifiuto della glossa) ha cambiato l’idea del libro diffusa nel Medioevo. Il nuovo disegno della pagina, di maggiore ordine e leggibilità, si è consolidato nei secoli, e la nuova immagine di libro è rimasta immutata, nonostante le innovazioni, nell’editoria moderna. Solo l’avvento delle nuove tecnologie digitali ha suggerito una nuova immagine, che, tuttavia, non è (...) ancora né pienamente definita né ben consolidata; alle posizioni di chi ha individuato il libro nuovo nella forma dell’ipertesto (letto anche sui vecchi pc), il saggio affianca le riflessioni di chi cerca l’immagine nuova nell’e-book letto su un e-reader, sottolineando tuttavia che si è solo agli inizi di una lunga trasformazione. This essay concerns the relationship between the image of the book and how it reads. It begins from the observation that only the change of the readers during the humanistic age has transformed the widespread perception of the book in the Middle Ages. The new layout of the page, neater and more readable, became well established in the following centuries, and that image of the book in the modern publishing industry has remained unchanged, in spite of innovations. New digital technologies have proposed a new image, that however is neither clearly defined nor well established. The essay underlines the observations of those who believe that the hypertext form is the new book, even readable on the old pc, and the observations of those that think of e-book as a new image, that can be read only on the e-reader. The essay ends with the idea that we are at the beginning of a long change. (shrink)

While poverty all over the world is more typical and extreme in rural contexts, interventions to improve cognition in low socioeconomic status children are for the most part based on studies conducted in urban populations. This paper investigate how poverty and rural or urban settings affect child cognitive performance. Executive functions and non-verbal intelligence performance, as well as individual and environmental information was obtained from 131 5-year-old children. For the same level of SES, children in rural settings performed consistently worse (...) than children in urban settings. These differences could be accounted mostly by the months of past preschool attendance and the father’s completed level of education. These results should inform policies and programs for children living in rural poverty worldwide, and specially in Latin America. (shrink)

The Baldwin effect is a process by which learnt traits become gradually incorporated into the genome through a Darwinian mechanism. From its inception, the Baldwin effect has been regarded with skepticism. The objective of this paper is to relativize this assessment. Our contribution is two-fold. To begin with, we provide a taxonomy of the different arguments that have been advocated in its defense, and distinguish between three justificatory dimensions—feasibility, explanatory relevance and likelihood—that have been unduly conflated. Second, we sharpen the (...) debate by providing an evolutionary game theoretic perspective that is able to generalize previous results. The upshot of this paper is that the mechanism envisaged by Baldwin is less puzzling than commonly thought. (shrink)

This article argues that evolutionary models based on selection validate, under appropriate conditions, the relevance of optimality as an explanatory mechanism in rational choice theory. The reason is that these frameworks share the mechanism that drives the results, namely, optimization, even if they situate it at different levels. The consequences of our argument are twofold. First, it resolves the tension between those predictions of rational choice theory that are accurate and the evidence showing that individuals seldom optimize. Second, it relativizes (...) the explanatory import of rationality without diminishing the role of optimization as a mechanism. (shrink)

René Girard’s mimetic theory has significantly influenced the fields of comparative literature and cultural studies, as well as sociological anthropology and philosophy. Nevertheless, I argue that a somewhat different line of interpretation, an interdisciplinary one, has not been sufficiently investigated. This involves an interpretation which focuses on the vicissitudes of the mimetic and “victimage” circle not (or not only) in sociological terms, but by analysing their articulation on the level of knowledge. The sociological and epistemological perspectives do not exclude each (...) other, but can be integrated. The main aim of this paper is to clarify this articulation, and to show that integration between these two perspectives is possible only by bringing into play a real ‘literary aesthetics’. The notion of literary aesthetics needs to be considered in both the common and the etymological sense, as a theory of feeling and of experiencing. In doing so, I firstly cover in brief the main stages of Girard’s thought in the light of this perspective, to then focus on the relationship between literary aesthetics and knowledge. Finally I argue that this picture, if seriously considered, could lead to a mystical outcome, and will discuss the possible alternatives to that outcome. (shrink)

Understanding evolution beyond a gene-centered vision is a fertile ground for new questions and approaches. However, in this systemic perspective, we take issue with the necessity of the concept of information. Through the example of brain and language evolution, we propose the autonomous systems theory as a more biologically relevant framework for the evolutionary perspective offered by Jablonka & Lamb (J&L).

Little is known about the impact of success and failure events on age-related changes in affect states and, particularly, in self-esteem levels. To fill this gap in the literature, in the present study changes in affect and self-esteem in 100 young (19 - 30 years) and 102 older adults (65-81 years) were assessed after participants experienced success and failure in a demanding cognitive task. Overall, the success-failure manipulation induced changes on affect states and on state self-esteem, not on trait self-esteem. (...) Regarding age differences, older and young adults were affected to the same extent by experiences of successes and failures. The Human Being in History affirms the ontological dignity of the human being, arguing that the challenges posed by the twenty-first century are not just political, economic, and social, but existential and metaphysical. In the face of these challenges, philosophy must show how to confront issues in a new way: not as problems that admit technical resolution, but as questions which involve openness to meaning and which demand the exercise of freedom.

In this paper, I interview Francesca De Vecchi (Full Professor of Theoretical Philosophy in Vita-Salute San Raffaele University) about her qualitative ontology and its social and normative implications. If at the foundation of our lifeworld there are significantly qualitative experiences, phenomenology can investigate the most important contemporary issues, such as gender disparity, socio-virtuality depersonalizations and political urgencies.

This book provides a discussion of the philosophy of being according to three major traditions in Western philosophy, the Analytic, the Continental, and the Thomistic. The origin of the point of view of each of these traditions is associated with a seminal figure, Gottlob Frege, Immanuel Kant, and Thomas Aquinas, respectively. The questions addressed in this book are constitutional for the philosophy of being, considering the meaning of being, the relationship between thinking and being, and the methods for using thought (...) to access being. On the one hand, the book honors diversity and pluralism, as it highlights how the three traditions may be clearly and distinctly differentiated regarding the philosophy of being. On the other hand, it honors a sense of solidarity and ecumenism, as it demonstrates how the methods and focal points of these traditions constitute, and continue to shape, the development of Western philosophy. This book contributes toward an essential overview of Western metaphysics and will be of particular interest to those working in the history of philosophy and in the philosophy of being. (shrink)

In her Investigation Concerning the State, Edith Stein takes up some of the main ideas of the social ontology presented by Adolf Reinach, and develops a social ontology of the state, of the law and of social acts. I argue that Stein’s social ontology is an eidetics of the state, the law and social acts. Stein identifies the essential relations that constitute the state, the law and social acts, i.e. pinpoints the parts upon which the state, the law and social (...) acts existentially depend as wholes. In doing so, Stein applies Husserl’s account of wholes and parts to the social domain. I also suggest that Stein outlines a regional ontology of sociality that embodies Husserl’s idea of regional ontology. I focus on the intertwining of the wholes-parts relations, which characterize Stein’s regional ontology of sociality, and argue that there are not only necessary but also possible parts within the wholes. This makes Stein’s regional ontology of the sociality a dynamic ontology. (shrink)
